I just can't win.

Urghhhh what a god awful day.

So I model and I am a photographer and also organise events but in my other life I worked successfully in travel for many years, I was unfortunately made redundant during the Lockdown and covid pandemic so have been doing casual bar work as well as my shoots.

My latest pub job was going well in a  family run local until the bosses eldest daughter (21 years old) who was put 'in charge ' took on the manager role and proceeded to belittle me at every opportunity and in the end I was dreading going to work, it's hard when you have managed a successful travel agency to go to being told off for not putting a glass on a shelf 'correctly'.

Things came to a head a few weeks ago when she called me outside in front of customers and yelled in my face about me not pulling my weight, this is not true and I was one of the best staff in that place, always going the extra mile for customers, I even took a terminally ill customer on holiday with me as he had no other family, did photography for them at no extra cost and participated in many fundraisers. Anyways I woke up the next day to a text saying I was no longer needed and as it was a casual 0 hour contract that was that. I feel that jealousy played a major part as she was always very snidey in her remarks about my work and photography. I was gutted but I brushed myself off and applied for a new travel agency that announced was opening up in the same village.

I aced the interview and was offered a position the very next day as store manager, something I knew I could handle and I knew I would bring invaluable experience.

I was then called 2 days later to say they had recruited a member of staff who just happened to be the owners other daughter and they had heard I worked at this pub and suddenly needed a reference from them even though it was totally irrelevant to this particular role. In the meantime I received a contract and job offer of a amazing salary.

I had no choice but to ask her for a reference and I was told it would be done.

I was meant to start this job tomorrow and have just received a email, not even a phone call to say the offer has been revoked due to a unsatisfactory reference, they will not disclose what it was but I am  not stupid. I'm completely floored  by this and actually thought my life was taking a turn for the  better and I would finally have a solid career.

I just needed space to vent because I have never been in this situation before and I can't believe people would be so bloody cruel to not only take away my bar role that I enjoyed but to sabotage my new job.

Why are people such arseholes!

Anyway that's that I've spent the last hour applying to other roles and what will be will be. In the meantime apologies in advance but expect some castings from me as I currently have 0 income and need to pay bills rent and feed my children.

Would you be able to obtain a copy of this reference by submitting Subject Access Requests to both companies... and then going through the Information Commissioner if they fail to comply and potentially a legal route if they do and its libelous?

By law, I am sure you cannot be given a negative reference, so that may be worth following up?

As much as I want to do its our local (not that I will going there anymore) it's a small area everyone knows everyone and word gets around the community so it isn't something I feel I can take on without being ostracized.

Sorry Kes.  Legislation is great, but it does require you, the aggrieved, to be really determined and be prepared to go into battle.   If you do feel you'd like to pursue it. I'd suggest you contact your local Citizens Advice.  Feel free to call if you decide to do so.   I know there's a variety of 'helpfulnesses' of local offices, so I might be able to give you some tips to get yourself attention.

Which is fine if you have nothing else on your mind, and /or can afford the time and money to do so.  I'm thinking you're being pragmatic by looking at castings etc to keep you going.

This!

Be warned though, it is still possible to write a negative or ambivalent reference without actually being negative; I've seen it many times whilst sorting through applications/references for teacher posts.

"If they give a reference it:

  • must be fair and accurate – and can include details about your performance and if you were sacked
  • can be brief – such as job title, salary and when you were employed"

Source (as already quoted above): https://www.gov.uk/work-reference

The latter of those two options is well understood amongst employers as code for 'don't touch this person with a barge pole'. A prospective employer receiving such a reference will usually either withdraw the offer without explanation or contact the referee by telephone for an 'off the record' discussion about the individual.

Consequently, there's nothing in writing that is actionable and I'd be amazed if the OP's referee wrote anything more than that. If they did, they're a foolish employer (there are some about).

FiL many employers will only ever give the basic factual employment details in a reference - particularly those with a professional HR department.
