:-( You should perhaps talk to the OP about who it was, and to admin. Twice would be a pattern in this case.
For the avoidance of doubt I'm still neutral on deposits. But even a non-refundable deposit exists only in the context of the service client failing to meet their end of the bargain. That seems a pretty obvious principle to stick to, and it should underscore why we shouldn't pay anyone a deposit if we don't know who they are and where they live.

One model I shot I know is very intelligent & successful outside modelling. Not all models do this because it's all they can do.

I model (and do photography) because I always have done and those are also areas of work that I enjoy. I work 6 days a week and some evenings. Most models I know also have other careers and are all very smart.

IANAL, but it still would not be non-refundable, since the party holding the deposit has declared they will not carry out the contract it is part of the consideration for.

Well done, what a load of hassle for £40, I'd chase it too, though, just out of principle, also now, if you do it again, hopefully not, at least you will be able to say, I took the last one to knock me for a deposit to court and they lost, so I'd advise you to return my deposit, it will save us both a load of hassle!

I suppose they do say they don't get into disputes about deposits.
Though hypothetically if this is one model doing exactly this thing more than once, it's not really about deposits anymore. It's about a potential pattern of fraud.
Did you ask what your options are re: leaving a negative reference?
